The Philippine Nickel Industry Association (PNIA) welcomed the Supreme Court’s decision nullifying a mining ban imposed by the Occidental Mindoro provincial government, calling it a significant step toward regulatory clarity and sustainable industry development.
PNIA said in a statement Thursday the High Court’s ruling “holds profound significance not just for the mining sector, but also for maintaining the delicate balance between local government authority and national laws.”
The industry group lauded the Supreme Court for upholding the rule of law, saying the decision affirms that local ordinances cannot override national legislation, particularly Republic Act No. 7942, the Philippine Mining Act of 1995.
“This ruling clearly establishes that while local governments have the authority to evaluate and approve mining applications, they cannot impose blanket bans on mining,” the group said.
PNIA emphasized that the decision provides needed regulatory certainty, which is expected to boost investor confidence and support long-term planning within the mining sector.
At the same time, the ruling reinforces the role of environmental safeguards, requiring project-specific assessments to ensure responsible operations.
“We fully support the Court’s reaffirmation of environmental protection as integral to mining, but within the boundaries of national laws,” PNIA said.
It said all mining projects must undergo rigorous environmental impact assessments and stakeholder consultations.
The group expressed readiness to collaborate with the national government, local government units and other stakeholders to align policies, improve regulatory oversight and promote responsible mining that contributes to inclusive growth and environmental stewardship.
“This decision paves the way for a more consistent, sustainable and inclusive mining policy framework that fosters economic growth while protecting the environment,” the group said.
