BCDA welcomes CA ruling on Capas landfill

State-run Bases Conversion and Development Authority (BCDA) welcomed the Court of Appeals’ decision to temporarily suspend the writ of preliminary injunction (WPI) issued by Branch 66 of the Capas Regional Trial Court on the Kalangitan Sanitary Lanfill case.

The injunction hindered the BCDA and Clark Development Corp. (CDC) from reclaiming the 100-hectare Kalangitan sanitary landfill in Capas, Tarlac.

The CA’s 10th Division, in a notice of resolution dated Dec. 16, 2024 related to case number CA-GR SP No. 186856, granted CDC and BCDA’s request for a temporary restraining order (TRO).

The TRO halts the implementation of the WPI issued on Oct. 29 by Judge Ronald Leo Haban of RTC Branch 66, Capas, Tarlac.

It also prevents any further action on the injunction case by Judge Haban or other courts until the appellate court resolves all issues raised in the petition. The TRO is effective for 60 days.

The BCDA said this is a step forward in addressing legal obstacles that impede the government’s pursuit of sustainable and transformative projects in New Clark City.

The planned industrial redevelopment of the landfill area is expected to generate about 30,000 jobs, benefiting more Filipinos, according to BCDA.
