THE Supreme Court (SC) on Wednesday affirmed that Marie Grace David is a qualified candidate for the position of vice mayor of Limay, Bataan.
The SC, meeting en banc, reversed a Commission on Elections (Comelec) resolution rejecting David’s certificate of candidacy (COC) for Limay vice mayor in the 2025 national and local elections.
The High Tribunal ruled that the Comelec committed “grave abuse of discretion” by disallowing the substitution of David, finding that she fully complied with the requirements of Sec. 77 of the Omnibus Election Code.
The decision permanently prohibited the Comelec from implementing its assailed Jan. 6, 2025 resolution and related issuances.
The Comelec earlier denied David’s substitution for allegedly failing to file her COC and Certificate of Nomination and Acceptance (CONA) within the prescribed period.
The SC issued last January a temporary restraining order preventing the COMELEC from implementing its resolution.
